Takumi Studio – Terms of Service

Welcome to Takumi Studio. These Terms of Service ("Terms") govern your use of our website (takumistudio.design) and the purchase of any products or services offered by Takumi Studio Inc. ("Takumi," "we," "us," or "our"). By accessing our website, subscribing to our newsletter, submitting an inquiry, or purchasing a product, you agree to these Terms.
1. About Takumi Studio
Takumi Studio Inc. is a design practice incorporated in the State of Arizona, United States, specializing in handcrafted Japanese stone water features for residential, hospitality, and institutional clients. Our products are sourced and hand-finished in Japan, with proprietary vessel engineering designed in-house.
2. Products and Orders
All products are made in limited quantities. Availability, pricing, lead times, and specifications are subject to change without notice. Confirmation of an order requires written acceptance from Takumi Studio, including a signed proposal or invoice.
Custom and made-to-order pieces are produced specifically for the buyer. Once production begins, these orders cannot be cancelled or modified.
Standard collection pieces may be cancelled within 48 hours of order confirmation, provided production has not yet begun.
3. Pricing and Payment
All prices are listed in U.S. Dollars (USD) and exclude applicable taxes, duties, and shipping fees, which will be calculated at checkout or in your invoice.
Our standard payment terms are 50% deposit upon order confirmation, and 50% upon completion before shipment, unless otherwise agreed in writing.
We accept payment via bank transfer, Stripe, and Wise. Payment must be received in full before any item is shipped.
4. Shipping and Delivery
Lead times vary by collection and customization. Estimated delivery windows will be confirmed in your order acknowledgment.
Shipping costs, customs duties, and import taxes are the responsibility of the buyer unless otherwise stated.
Risk of loss and damage transfers to the buyer upon delivery to the carrier. We strongly recommend that buyers inspect shipments immediately upon receipt and report any visible damage to the carrier and to Takumi Studio within 48 hours of delivery, accompanied by photographs.
5. Returns and Refunds
All sales are final on custom and made-to-order pieces.
Standard collection pieces may be returned within 14 days of delivery, provided the item is in original condition and packaging. The buyer is responsible for return shipping costs and insurance. A 15% restocking fee may apply.
Damaged in transit: If your piece arrives damaged, contact us within 48 hours of delivery with photographs. We will arrange replacement, repair, or refund at our discretion.
Refunds are issued to the original payment method within 14 business days of receiving the returned item in acceptable condition.
6. Intellectual Property
All content on this website — including text, photography, illustrations, product designs, and the proprietary vessel engineering — is the exclusive intellectual property of Takumi Studio Inc., protected under United States and international copyright, trademark, and patent law.
The closed-loop vessel system integrated into Takumi Studio pieces is the subject of a pending patent application. Reverse engineering, replication, or reproduction of our designs is strictly prohibited.
Purchase of a Takumi Studio product grants the buyer the right to install, display, and resell the physical piece. It does not grant any license to:
Replicate or manufacture similar products,
Use Takumi Studio's product photography, branding, or design language in marketing or portfolios without written permission,
Claim authorship of the design in any professional, editorial, or commercial context.
Designers, architects, and landscape professionals incorporating Takumi Studio pieces into their projects must credit Takumi Studio in published materials.
7. Trade and Wholesale
Verified design and trade professionals may apply for trade access, including wholesale pricing and project-specific terms. Trade applications are reviewed individually and require documentation of professional standing.
Trade pricing, exclusivity terms, and project commissions are governed by separate written agreements between Takumi Studio and the trade partner.
8. Limitation of Liability
Takumi Studio products are designed for outdoor and indoor decorative installation. Buyers are responsible for:
Proper installation on a level surface,
Compliance with local electrical codes for the integrated pump system,
Routine maintenance as outlined in the product care guide.
Takumi Studio is not liable for:
Damage caused by improper installation, neglect, freezing temperatures, or modifications,
Indirect, incidental, or consequential damages arising from use of our products,
Third-party services (shipping carriers, installation contractors, payment processors) beyond our reasonable control.
To the maximum extent permitted by law, Takumi Studio's total liability for any claim shall not exceed the purchase price of the product giving rise to the claim.
9. Privacy and Confidentiality
Information you share with us — including project briefs, site details, and personal contact information — is handled in accordance with our Privacy Policy.
We treat all client communications as confidential. We will not disclose, reuse, or share your information without your permission, except as required by law.
If you require a mutual non-disclosure agreement (NDA) before sharing project details, please indicate so in your initial inquiry.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law principles.
Any disputes arising from these Terms or your relationship with Takumi Studio shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to mediation in Phoenix, Arizona. If mediation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Phoenix, Arizona.
You agree that any arbitration shall be conducted on an individual basis and not as a class action.
11. Updates to These Terms
We may update these Terms from time to time. Material changes will be communicated via our newsletter or on this page with an updated effective date. Continued use of the website or purchase of products after changes are posted constitutes acceptance of the updated Terms.
